Significant Developments Re: LICH today!

Hello from CG CORD

There are very significant developments regarding LICH today:

SUNY Downstate must return LICH assets, Brooklyn judge rules

http://www.brooklyneagle.com/articles/suny-downstate-must-return-lich-assets-brooklyn-judge-rules-2013-08-20-200000

Cites SUNY’s `sinister purpose'

By Charisma L. Miller, Esq.

Brooklyn Daily Eagle

"Brooklyn Supreme Court Justice Carolyn Demarest found that the State University of New York Downstate (SUNY Downstate) violated a contractual obligation in the asset transfer of Long Island College Hospital (LICH) property and has ordered that LICH assets be transferred back to the hospital.
As previously reported in the Brooklyn Daily Eagle, in May 2011, LICH requested and was granted the opportunity to transfer some of its assets to SUNY. The order was granted under the express declaration that “SUNY Downstate will continue [LICH’s] operation as a hospital.”
(More on this story here.)"

"SUNY has since then made clear its intent to close LICH and cease its existence as a functioning hospital, in direct contradiction to its 2011 declaration. In June 2013, Demarest ordered SUNY to provide an accounting of the property transfer and related monies in an attempt to ensure that the parameters of the 2011 order were being followed."

"SUNY submitted the court requested documents on Aug. 5, 2013."

"SUNY’s recent assertion that it must close LICH because of financial reasons — specifically that it is losing a significant amount of money by keeping LICH open as a functioning hospital and ER — did not persuade Demarest. In 2011, SUNY Downstate was “well aware of the deficit operating condition of LICH” at the time of the asset transfer, Demarest noted."......(edit).....

From Save Gowanus: GOWANUS REGATTA DANGEROUS PR STUNT

Hello from CG CORD

This June 14, 2013 post from Save Gowanus is a must read.

GOWANUS REGATTA DANGEROUS PR STUNT WARNS COMMUNITY GROUP

http://savegowanus.org/gowanus-regatta-dangerous-pr-stunt-warns-community-group/

"NUMEROUS CARCINOGENIC RISKS ASSOCIATED WITH RECREATIONAL USE OF THE CANAL, PARTICULARLY FOR CHILDREN, ACCORDING TO EPA DATA
RACE IS A PLOY FOR PROPOSED LIGHTSTONE DEVELOPMENT

June 13, 2013, BROOKLYN, NY – The pro-smart development group Save Gowanus is opposing The Lightstone Group’s sponsorship of the June 15 Gowanus Regatta, a canoe race on a toxic, chemical-filled Superfund site. While Gowanus residents can’t wait for the day when the canal is clean for recreational activities, right now, it is a fetid pool of harmful chemicals and bacteria.
Save Gowanus is concerned for regatta participants, with dangers of splashing and capsizing, first responders who may have to rescue canoers and also for neighborhood children who may believe the canal is safe for boating.

But mostly, the group worries this race is a political ploy by the Lightstone Group and its allies to convince the public the canal is safe. “Lightstone is trying to send the message out that it’s safe to be in the canal and it’s not as bad as everyone says,” says Carl Teitelbaum, a member of Save Gowanus. “But it’s worse.”

The Environmental Protection Agency extensively examined the Canal and found that
it is contaminated with a variety of pollutants, including polycyclic aromatic hydrocarbons (PAHs), volatile organic contaminants (VOCs), polychlorinated biphenyls (PCBs), pesticides, and metals that traverse the entire length of the canal. Many of the detected contaminants are known carcinogens, capable of causing cancer and other neurological impacts. The EPA has said people who come into contact with the water are at risk of exposure to these harmful pollutants.

And Riverkeeper, a nonprofit group focued on water quality, found high levels of Enterococcus bacteria in the canal as well due to the canal’s repository for human waste when the local sewage system overflows.. Exposure to this bacteria can lead to gastritis and diarrhea. (see Riverkeepers report below, p. 23 and p. 37).

The Gowanus Dredgers, sponsors of the race, says that “all waters of NYC Inner Harbor are contaminated.” We feel this grossly inaccurate based on the science.
Save Gowanus worries about the impact this race could have our neighborhood children in particular who are impressionable. We would not want them emulating this behavior in any fashion. We are surprised how the health and safety officials in the community is allowing this happen.
Lightstone wants to build two 12 story towers housing more than 700 apartments in the environmentally sensitive Gowanus Canal region. They are sponsoring this race to convince the public that the canal is safe. Save Gowanus argues that the canal will only be clean when the EPA finishes its Superfund cleanup......."

Last night's Save Gowanus Community Rally w/Bill Thompson

Photos:  Warren Cohen of Save Gowanus speaks to mayoral hopeful Bill Thompson about the ginat Lightstone Development. Photos by Triada Samaras

Last night, at a rally organized by Save Gowanus. residents, community leaders, and groups from Carroll Gardens/Gowanus turned out near the banks of the pungent and bacteria filled Gowanus Canal to voice their grievances regarding the impacts of the Lightstone Development on the Greater Carroll Gardens/Gowanus Community.

Mayoral hopeful, Bill Thompson, listened thoughtfully on the Carroll Street Bridge as Warren Cohen of Save Gowanus, Marlene Donnely from FROGG Friends and Resdients of Greater Gowanus , and others spoke to Mr. Thompson in earnest about the massive size of the Lightstone Development Development and the many concerns the project raises for our community.  Mr. Thompson seemed to suggest "patience is a virtue" when it comes to planning developments the size of Lightstone, and that such developments must serve the the existing community even as they bring in large numbers of new residents.

The site of the development, so close to the water's edge, is the same exact spot where Hurrican Sandy wreaked flooding havoc last fall.

Save Gowanus is composed of Gowanus residents and home-owners living near the site on Bond Street between Carroll Street and 2nd Street, as well as members of civic groups Friends of Bond (FOB) and Friends and Residents of Greater Gowanus (FROGG).

Urgent! Gowanus Community Rally Thursday Eve. w/ Bill Thompson

Community Rally!

Thursday August 8th at 7:30pm

Carroll Street bridge

There will be a rally on Thursday night at the Carroll Street bridge to protest the Lightstone project on the toxic Gowanus Canal and publicly air our grievances.  Bill Thompson is scheduled to attend and will be speaking with concerned community members. The media has also been invited. This is not a rally to endorse Thompson's mayoral candidacy; instead, it is a chance to bring broader attention to our issue of irresponsible development (which endangers scale, zoning, schools, transit and health and safety) in the context of the mayoral race.
It is extremely urgent that as many of you attend as possible. Please invite your neighbors as well.
We need to show all our elected representatives how important this issue is to our community. They've already heard from the developers and their lobbyists; now it's our turn to be heard. This is the protest that will hopefully help bring attention to our issue in the media and the mayoral race.

Please be there and bring the kids and a friend.

CORD HISTORY:

With the "Protect Our Homes" petition, CORD was formed in May, 2007. This petition arose as an overwhelmingly negative response to the coming of the over-sized 360 Smith Street Development at the corner of Smith Street and Second Place (Aka Oliver House; aka 131 Second Place). This petition, which had well over three thousand signatures, led to a new zoning text amendment in summer of 2008.

To: Our Elected Officials, Community Leaders, The MTA:
(MAY, 2007)

We the undersigned Carroll Gardens homeowners and residents, are appalled by the "as of right" ruling which allows owners and developers to erect buildings in our neighborhood with no regard to the impact they will present to our quality of life and the value of our homes........
